Use of the www.mjperromat.com website implies full acceptance of the general conditions of use described below.

These conditions of use are subject to be amended or supplemented without notice; it is therefore recommended that users of the www.mjperromat.com website refer back to them on a regular basis.

This website is normally accessible to users at all times. However, www.mjperromat.com may decide to suspendaccess in the case of a technical maintenance operation; if such a situation were to arise, www.mjperromat.com will strive to inform users of the dates and times of maintenance in advance.

Vignobles M&J Perromat strives to provide information that is as accurate as possible on its www.mjperromat.com website. However, the company cannot be held liable for omissions, inaccuracies and shortcomings linked to updates, whether they be of its own doing or that of third party partners who have provided the information.

In accordance with the provisions of articles L.335-2 and the intellectual property Code, all unauthorised misuses of the website or any of its elements will be regarded as constituting an infringement and will be legally pursued.

Limitations of liability.

Vignobles M&J Perromat cannot be held responsible for direct or indirect damage to the user’s equipment, occurring after access to the Vignobles M&J Perromat website either with computer equipment that doesn’t comply with the specifications described in clause 4, or caused by the occurrence of a computer bug or incompatibility.

Vignobles M&J Perromat cannot be held responsible either for indirect losses (including for example the loss of a market or of an opportunity) resulting from use of the www.mjperromat.com website.

Users have access to the interactive spaces (opportunity to ask questions on the contact form). Vignobles M&J Perromat reserves itself the right to remove, without prior formal notice, any content posted within this space violating applicable French legislation, in particular, regarding provisions on data protection. If applicable, Vignobles M&J Perromat reserves itself the right to implicate the user’s civil liability and/or criminal liability, in particular in the case of messages of racist, abusive, slandering or pornographic nature, whatever the medium used (text, photo...).

Personal data management.

In France, personal data is protected in accordance with laws n° 78-87 dated 6th January 1978, n° 2004-801 dated 6th August 2004 and article L. 226-13 of the Penal Code and European directive dated 24th October 1995.

When using the www.mjperromat.com website, the following information can be collected: URLs of the links via which the user accesses thewww.mjperromat.com website, the user’s service provider, the user’s Internet Protocol address (IP).

In any event, Vignobles M&J Perromat only collects users’ personal data for the requirements of some of the services offered by the www.mjperromat.com website.  The user provides such information knowingly, in particular when he or she enters the data him/herself. None of the www.mjperromat.com  user’s personal data is published without the user’s knowledge, nor is it exchanged, transferred, given away or sold by whatever medium to third parties.  Only if Vignobles M&J Perromat and its rights were to been bought out, would this information be transferred over to a potential buyer who in turn, would be held by the same obligation of preservation and modification of data concerning users of the www.mjperromat.com website.

The website is not registered with the CNIL (national data protection authority for France), because it does not collect personal data.  

The databases are protected by provisions of the law dated July 1st 1998, which implemented the 96/9 directive of March 11th 1996, related to legal protection of databases.

The www.mjperromat.com website houses several links to other websites that were set up with Vignobles M&J Perromat’s consent.

However, Vignobles M&J Perromat is unable to verify the contents of these websites and therefore will in no way be held responsible.

Applicable law and election of jurisdiction.
